These Terms of Use ("Terms") govern your access to and use of the website at www.dayalabs.com (the "Website"), operated by Laboratoires Daya Inc., doing business as Daya Labs ("Daya Labs", "we", "us" or "our").

By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

1. About the Website

Daya Labs builds software and automation for home care agencies, including the Dayacloud platform, and provides related professional services. The Website gives general information about our company, products and services.

These Terms apply only to the Website. Access to Dayacloud and any services we provide to clients is governed by a separate written agreement between Daya Labs and that client, which prevails over these Terms for that subject matter.

2. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page with a new "Last updated" date. Your continued use of the Website after that date means you accept the updated Terms.

3. Acceptable use

You agree to use the Website lawfully and in line with these Terms. You must not:

• Introduce viruses, ransomware or other malicious code.

You may view, download and print Website pages for your personal or internal business use, as long as you do not modify them or remove any notices. Any other use requires our prior written permission. Nothing in these Terms gives you any right in the Daya Labs or Dayacloud names or logos.

When you contact us through the Website, you agree that we may reply electronically. Any marketing messages we send comply with Canada's Anti-Spam Legislation (CASL), and you can unsubscribe at any time with the link in each message or by writing to us.

6. Privacy and cookies

Our Privacy Policy explains how we handle personal information collected through the Website, including the analytics cookies set by Google Analytics and HubSpot. We do not use advertising cookies.

13. Governing law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. Subject to any mandatory rights you have under the law of your place of residence, the courts of the Province of Quebec have exclusive jurisdiction over any dispute relating to these Terms or the Website.

14. Language

These Terms are available in French and English. Both versions have the same effect.

15. General

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms and our Privacy Policy are the entire agreement between you and Daya Labs about your use of the Website.
